18 USC 922(g)(8) prohibits a person subject to a domestic violence restraining order from possessing a firearm. In March, 2023, the Fifth Circuit held that such prohibition violated the Second Amendment. United States v. Rahimi, 61 F.4th 443 (March 2, 2023). However, the U.S. Supreme Court just granted cert. in Rahimi, 2023 U.S. LEXIS 2830 (June 30, 2023). This presents an opportunity for the Supreme Court to clarify its ruling in Bruen, 142 S.Ct. 2111(2022) and hold clearly that the Second Amendment allows legislatures to protect the safety of its citizens by prohibiting (1) the possession of Glock switches and (2) spouse abusers from carrying guns.
